How Braqon collects, uses, and shares personal information on the US branch of this website (/us/) — including hub, product pages, blog, FAQ, and pilot request forms. This notice is written for US law and US operations. It is not an EU GDPR privacy policy.

Important. This document is a technical draft for the US website and B2B buyers. It is not legal advice. Have US counsel review it before production go-live, including California CPRA, TCPA, and any state “mini-TCPA” or privacy laws that apply to your campaigns.

Scope

2. Who this notice covers

This notice applies primarily to:

  • US B2B buyers and prospects who request information, a pilot program, or pricing for exclusive leads (Final Expense, Roofing & home services, Debt Relief, Medicare, and related US products).
  • Visitors to English US pages under /us/ (hub, verticals, blog, FAQ, forms).

If you are in the European Union / EEA, this page is not your primary privacy policy. Use the English GDPR-oriented notice or the Italian GDPR notice. If you use the LatAm branch, see the LatAm Privacy Notice.

US frameworks

3. US laws and frameworks we design for

Depending on where you live, how we contact people, and the nature of the campaign, US operations may be shaped by — among others:

  • California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA) and similar state privacy laws (e.g., Virginia, Colorado, Connecticut, Utah, and others as they apply).
  • Telephone Consumer Protection Act (TCPA) and FCC telemarketing rules for calls, autodialers, prerecorded messages, and SMS where applicable.
  • Telemarketing Sales Rule (TSR) and related FTC guidance.
  • National Do Not Call (DNC) registry requirements and internal suppression obligations.
  • State telemarketing and “mini-TCPA” rules that may impose additional consent or calling-hour limits.

Braqon’s US operating standard for lead inventory is: exclusivity where sold as exclusive, documented consent where required for the channel, DNC/opt-out hygiene, and honest product labeling (exclusive web, live transfer, aged). This notice describes site/form data practices; product delivery terms also appear in buyer agreements and product pages.

Categories

4. Personal information we collect on the US site

Through US forms and site use we may collect:

  • Identifiers: name, email address, phone number.
  • Professional / commercial information: company or agency name, vertical of interest, estimated monthly volume, free-text message, states or program notes you choose to provide.
  • Internet or other electronic network activity: IP address, browser user-agent, referring page, date and time of submission (security, anti-abuse, and consent documentation).

We do not ask for special categories such as health diagnoses, government ID numbers, or precise geolocation through the standard US pilot form. Medicare or Final Expense product leads delivered to buyers are governed by capture-path consent and buyer contracts (see Section 11), not by this website form alone.

Use

5. How we use the information

  • a) Respond to your request. Handle pilot, pricing, and product inquiries submitted on US pages.
  • b) Relationship management. Contact you by email or phone about your request, onboarding, and service delivery.
  • c) Marketing (optional / as permitted). Send Braqon product updates or offers if you have agreed or as otherwise allowed by law. You can opt out at any time.
  • d) Security and fraud prevention. Protect forms and systems from bots, spam, and abuse.
  • e) Compliance and records. Keep submission metadata to demonstrate consent, handle disputes, and meet legal obligations.
  • f) Legal process. Respond to lawful requests and establish or defend legal claims.

Required form fields are needed to process your inquiry. Refusing them may make it impossible to respond. Withdrawing marketing consent does not erase a request already in progress unless that contact channel is the only way to complete it.

Sharing

6. How we share information

We may share personal information with:

  • Service providers / processors that host the site, run email, CRM, analytics (if enabled), or support operations under contract.
  • Professional advisers (legal, accounting) under confidentiality where needed.
  • Authorities when required by law or valid legal process.

We do not sell personal information submitted through the US B2B pilot form to third parties for their independent marketing. If “sale” or “sharing” under CPRA (including certain cross-context behavioral advertising) ever applies to a specific tool we enable, we will update this notice and provide a clear opt-out path.

To exercise a “Do Not Sell or Share My Personal Information” request (California and similar laws), email [email protected] with your name, the email used on the form, and the request type.

TCPA · calls & texts

7. Calls, texts, and TCPA-minded practices

If you provide a phone number and agree to be contacted about your inquiry, we may call or email you regarding that request. If marketing texts or automated/prerecorded calls are used, they are sent only with the consent required for that channel and campaign type.

  • Consent is not a condition of purchase of any Braqon product or pilot package.
  • Message and data rates may apply; message frequency varies when SMS is used.
  • You may opt out of marketing texts by replying STOP (or as instructed in the message). Reply HELP for help where SMS is offered.
  • You may ask to stop marketing calls by telling the agent or emailing [email protected].
  • We honor opt-outs and maintain internal suppression lists for US outreach we control.

Public resources for consumers include the FCC guide on unwanted calls and texts and the FTC Do Not Call information. Those pages are consumer education; your counsel should interpret obligations for your business.

CCPA / CPRA

8. Your US state privacy rights (including California)

Depending on your state of residence, you may have rights to:

  • Know / access the categories and specific pieces of personal information we collected about you.
  • Correct inaccurate personal information.
  • Delete personal information, subject to legal exceptions.
  • Opt out of sale or sharing of personal information (as those terms are defined under applicable law).
  • Limit use of sensitive personal information, where that category applies and the law provides the right.
  • Non-discrimination for exercising privacy rights.

To exercise rights, email [email protected] with your full name, contact email, state of residence, and the request. We may need to verify your identity before completing the request. Authorized agents may submit requests where state law allows, with proof of authorization.

California residents may also designate an authorized agent under CPRA procedures. We will respond within the timelines required by applicable law.

Retention

9. How long we keep information

We keep US form and related contact records for approximately 24 months from the last contact, unless a longer period is required by law, needed to complete a transaction, or reasonably necessary to establish or defend legal claims. We then delete or de-identify the data.

Security

10. Security

We use reasonable administrative, technical, and organizational measures appropriate to the nature of the data (access controls, HTTPS in transit, submission logging, anti-bot measures on forms). No method of transmission or storage is 100% secure. If we become aware of a security incident that requires notice under applicable law, we will act as required.

Lead product

11. Clarification: website visitors vs. leads we sell to buyers

This notice governs personal information you send us as a visitor or B2B buyer on the US site.

When Braqon supplies exclusive leads or live transfers to US buyers (for example Final Expense, Medicare, Debt Relief, or Roofing prospects), those activities are also governed by:

  • the commercial contract and any data/processing schedules with the buyer;
  • the consent language, timestamp, source, and channel scope captured at lead generation;
  • TCPA, DNC, state telemarketing rules, and any vertical-specific marketing rules (including Medicare marketing constraints where applicable);
  • the buyer’s duty to use leads only within authorized channels and to honor opt-outs and suppressions.

Cookies

12. Cookies and similar technologies

The US site may use strictly necessary cookies for basic operation and, if enabled, measurement or preference tools. You can block non-essential cookies in your browser settings. If we enable non-essential analytics or advertising cookies that trigger CPRA “sharing” obligations, we will update this notice and provide opt-out mechanisms as required.

Children

13. Children

The US site and lead products are directed to businesses and adult consumers. We do not knowingly collect personal information from children under 13 on the US pilot forms. If you believe a child provided information, contact us and we will delete it as required.

Changes

14. Changes to this notice

We may update this US Privacy Notice. The “Last updated” date at the top shows the current version. Material changes may be highlighted on the site or communicated to recent form submitters when appropriate.
